Extractly LLC ("We," "Our," "Us," "Extractly") provides an online data extraction and analysis service platform that allows You to process and analyze various types of documents and data (the "Service"). Subject to these Terms, Registered Users are granted a nonexclusive, limited, nontransferable license to use the Service only as permitted by its features. Extractly reserves all rights not expressly granted herein in the Service and the Extractly Content.

3.2 Restrictions

You agree not to, and will not permit others to:

• License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit the Service;
• Modify, make derivative works of, disassemble, decrypt, reverse compile or reverse engineer any part of the Service;
• Remove, alter or obscure any proprietary notice (including any notice of copyright or trademark) of Extractly or its affiliates, partners, suppliers or the licensors of the Service.

4. User Content

You retain all rights in, and are solely responsible for, the content you upload, submit, post, create, or display through the Service ("User Content"). By submitting User Content, you grant Extractly permission to process and analyze this data solely for the purpose of providing the requested Service. We will delete your User Content after we have completed this business purpose. Extractly does not claim any ownership rights or title to your User Content beyond the limited permission to process it as described.

5. Privacy and Security

Your use of the Service is subject to Extractly's Privacy Policy. Please review our Privacy Policy, which also governs the Service and informs users of our data collection practices.

6. Payment Terms

6.1 Active Account

Use of the Service requires You to have an active account in good standing. This means You must maintain a valid payment method and pay all fees and charges incurred by Your account on a timely basis.

6.2 Fees and Charges

You agree to pay all fees associated with the Service. Fees are non-refundable except as required by law or as explicitly stated in these Terms. Extractly reserves the right to change the fees for the Service at any time upon reasonable notice.

6.3 No Refunds

All purchases are final and non-refundable, except at Extractly's sole discretion or as required by applicable law. If You believe You are entitled to a refund, please contact our customer support team.

6.4 Late Payments

If Your payment is not received by the due date, Extractly may suspend or terminate Your access to the Service. You will be responsible for all reasonable expenses (including attorneys' fees) incurred by Extractly in collecting unpaid amounts.

7. Termination

We may terminate or suspend Your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms. Upon termination, Your right to use the Service will cease immediately.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Extractly be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the Service.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of New York, without regard to its conflict of law provisions.

By using the Service, you agree to these Terms. If you do not agree to these Terms, please do not use the Service.
